Fatalis is a black dragon, not an elder dragon. Its classified as something that can wipe out civilizations itself, and to the point where any record of its existence is erased from history. It "doesnt exist".
Elder dragon is mutually exclusive with everything else. Elder dragon is just "we dont know what you are, so you go here".
of which all black dragons would apply to.
Apparently the major distinction is if it's a threat to a continent or to the whole planet. Kush isn't weird here, as it's mostly just annoying.
Gore Magala is not classified as an Elder Dragon. It's adult form Shagaru Magala is an Elder Dragon, but the baby Gore Magala is not. For some inexplicable reason. Gore Magala is in a different classification entirely on its own.
A monster does not have to have control of a natural element for it to be classified as an elder dragon. For example, Chameleos and Yama Tsukami have no real control of any element or power (being able to poison hunters does not constitute control of an element). They simply just exist and don't fall in line with anything else.
Black dragons cannot be elder dragons because elder dragons are unclassified. Their only similar trait is that they share no traits in common with any other monster enough to be a singular classification.
A "dangerous first class monster" is a classification in itself, therefore it is not an elder dragon, as every dangerous first class monster shares the same traits with other dangerous first class monsters.

Its not a square rectangle moment, the definition of elder dragon excludes any other possibility. The moment it goes in any other classification, its no longer an elder dragon.
kirin and fatalis are both elder dragons, one is simply a black dragon also.
