My pc is ancient from 8 years ago, I get 60 fps, I was getting 30-40 in the beta.

If your PC is above the minimum requirements and you still have problems, you might be able to make a case, but probably not. That's pretty far past the 2-hour period.
they will deny the refund request with five hours.

Yeah there's a good chance they'll do it. Just tell them you tried to get it working, but the game is horribly optimized.

I've gotten money back over the 2 hours and they gave me refunds Before they had the policy for good reasons
Already sent request, I'll update again
The things is my 5 hours playtime, 4 hours I was trying to make the game run smooth but sadly it can't.

They most likely will. Just say its broken and crashes for you all the time. Which is the case most likely anyway. They'll refund you

Yes, ignore the people that say no. You just need to get in touch with an actual human at Steam and explain the issue, they're usually pretty reasonable. If they say no, say that your issue isn't resolved, and Steam will automatically connect you to a different employee for help. I've refunded games with 12 hours of playtime, you just need to provide a good reason.

If your comment highlights that you spent significant time trying to get the game to run with decent performance but failed, there is a higher chance they will refund you.

Just make sure you emphasize that the game is basically unplayable for you. You can mention that the benchmark score/Beta performance was different too. Denuvo is in the release version, which is adding large performance strain.
