We didnt add the Bioshock games. Physics running at 30fps is not a good enough reason for it to go on the list. The entire game must run at 30fps for it to be included on the list. Bioshock does not, it runs faster than that.

Can't find a direct source on this, however according to Wikipedia it was developed in Flash, supporting the idea of the lock.

By the developer's own admission the lock is a bug in a system that automatically switches locks based on system capability. Since it's being looked into, I personally would recommend against listing it.
It actually only states that it's also available in flash platform, meaning browser version. There's no info what does the standalone release use.
However you are in right path as engine sometimes tells if the game is locked at some frame rate, which include flash (and related like adobe AIR, HaxeFlixel, etc.), GameMaker and XNA.
That game actually would require some sort of cap or fixing, because the game has bug at the very beginning where holding onto ledge in tutorial won't work if game is running at 144 FPS.
That said, the game is uncapped and has forced vsync. I'm guessing that automatic adjustement basically means regular vsync, which drops the frame rate to 30 FPS if it goes even one frame under 60. Would like to know for those who it's running 30 FPS how much does disabling vsync from GPU help.
