Prosecuting Burning of the American Flag

First of all, no, Trump has not signed an executive order making flag burning illegal.
Presidents do not have the power to create criminal statutes or make something illegal by executive order, no matter what the point of contention is.

What Trump’s EO actually did was instruct the attorney general to “prioritize the enforcement to the fullest extent possible of our Nation’s criminal and civil laws against acts of American Flag desecration that violate applicable, content-neutral laws, while causing harm unrelated to expression, consistent with the First Amendment. This may include, but is not limited to, violent crimes; hate crimes, illegal discrimination against American citizens, or other violations of Americans’ civil rights; and crimes against property and the peace, as well as conspiracies and attempts to violate, and aiding and abetting others to violate, such laws.”
In other words it directs the Department of Justice to enforce laws that already exist on the book and were put there by the same people that are calling Trump a fascist for doing his job, aka enforcing laws that Congress has approved.

Furthermore, it directs the Secretaries of State and Homeland Security, alongside the Attorney General, to terminate the visas or naturalization processes of any immigrant that is caught on record desecrating the American flag *where* such remedies are allowed under existing Federal law.


With that out of the way, no the Supreme Court never ruled that you have an unfettered right to burn the flag.
The 1989 case stated that what Johnson did in burning the American flag outside of the Republican National Convention was an entirely political act and that it was protected under the First Amendment.

They however noted, right in that decision, that “no disturbance of the peace actually occurred or threatened to occur because of Johnson's burning of the flag,” and in a footnote said the protester “was prosecuted only for flag desecration — not for trespass, disorderly conduct, or arson.”

Which doesn’t make neither burning the flag legal in every possible scenario (which is why Trump is instructing the DOJ to pursue litigation to clarify this issue) nor that you can’t still be prosecuted for any other unlawful action committed while burning the flag.


It is very easy to argue that were there to be a “disturbance of peace, or the threat therefore” because of the burning of the flag such action would not fall under the scope of the First Amendment.
Not because Trump said so but because the Supreme Court themselves clearly stated that to be the case all the way back in 1989.
And you can still be arrested and prosecuted under any other criminal statute which, for example, prohibit the burning of objects in specific areas (public parks, school yards etc etc).


But sure, keep crying fascism because Trump is enforcing laws made by the people telling you that Trump is a fascist.. that will work wonders for you in the long run
