Orpheus is special, the Emperor is not (beyond having an unusually strong will). Withers confirms that Orpheus (or the PC or Karlach) is still the same person (and he'd know, being who he is). Presumably due to being in the Prism or due to Orpheus' immunity to Illthid powers they retain their soul.

I think what withers says in the ending is special too : the PC becoming a mindflayer to fulfill withers' mission is done under the overlook of Ao himself (imo that's him who allowed/missioned Jergal to intervene in the story), so bending the rules is possible. Litteraly a deus ex machina.

The emperor is a normal case : he chose to become a mindflayer, and lost his soul, the reason why he couldnt feel empathy anymore even toward his best friend Ansur.
I'd be surprised if Ao intervened, he's not been known to help or hinder mortals, just gods. If Ao wanted the plot stopped he'd just stop it; when he decides to intervene he is not remotely subtle about it.
Jergal doesn't need special permission to do what he's doing; he's following the rules. Withers is an Avatar of Jergal, that's allowed.
So I think it's Orpheus' influence.
What I find interesting is Omeleum. He was also a normally created Mind Flayer, only different due to being a sorcerer, which can randomly happen with any living being. From his backstory it's clear he also lacked empathy even after being freed from Elder Brain control but managed to teach himself empathy and morality by pure logical observation. I kinda love that.
