That would've brought a ton of legal issues. Like hiring anyone that made a fan game.
Nintendo could go to court for that and it'd be a mess. Frankly, that's just a possibility. If we look at what VALVe does we can also see another perspective of how this should be treated. However, Nintendo's a Japanese company and I'm pretty sure the law's relatively different.

As he called it Pokemon, probebly used some of the names a barrowed from the game's them selves, then it does cross the line into a copyright violation, even if it is free.
Reguardless of how long he has been working on it, if Nintendo didn't hear about it until now, then they still have a right to stop it. Same with the Metroid 2 remake.
This isn't abuse of copyright laws, it is proper enforcement of them.
If your going to spend 9 years making a clone of a game that you giving for free you should only make it for you and your freinds or ask before starting the project, I ain't no law expert but surely you have to get permission before making a clone of a game?
Any pokemans that looked similar would also be verboten. He'd be better off making a completely new IP.
