A remake of BattleTanx: Global Assault, please!

Ah, BattleTanx. This game defined my childhood. Do you realize how many hours of my childhood I spent on this game? It has everything: tanks, nukes, turrets, tanks, good AI, an addicting multiplayer mode, tanks, lotsa weapons, and a great number of maps. Oh, and did I mention tanks?

That's why it sucks that 3DO went bankrupt in 2003, meaning the BattleTanx franchise is dead...

Or is it?

The legal rights to BattleTanx seems to have just disappeared. I searched all over the web, but as far as I can tell, the copyright (or is it a trademark?) seems to have died with the company...

My point is, can someone please remake this game into an online multiplayer game and release it here on Steam?

(For those of you who never heard of this game, see if you can get a copy for the N64 or just emulate it.)

If someone takes this up, could you buff the Marksman tank? It seems to really need it.

How does copyright work if the company went under? I mean, they're no longer profiting off this game. I don't see the harm in at least making an homage.
