Being on the index doesnt mean automatically its forbidden to be sold.
Restrictions about selling do not affect the users ability to possess (things that arent a criminal goods)
Second even if the Steam advertisment was shown to him it wasn't intended as a direct advertisment for that game but for the entire franchise and with Retro Revenge being allowed to be sold that would mean the advert was allowed.
Its not that he cant open the store page, there is NO shop page for the game if your store is set to Germany.
While its true that you can activate keys on a German account without a problem, Steam is not allowed to sell the game in Germany.
The game is not seized or forbidden.
Therefore it can be sold to adult people.
