It seems the problem could be the curvature of the road in the base building on the top right side between the garbage parking lots and the containers.
However, with anarchy mod this works - but I would not rule out that this might brick the game at some point sooner or later.
1) use the Anarchy mod options to disable the 'Invalid shape' error, or
2) use -developerMode and in the Simulation tab check the 'Bypass validation results'.
With Anarchy,
1) select any tool [like the Bulldozer] that displays the Anarchy button
2) click the gear icon to open the Anarchy Options window
3) locate 'Invalid Shape' and toggle to 'Always', then deselect the tool
4) go back to the Incinerator and upgrade the depot
