If you already have a good cooler, then it's a problem with thermal paste quality, which differs by brand, and stock paste is not always the best. Thermal pads are even worse. Some coolers can be duds too, or just clogged with dirt. Your windows power profile can also affect thermals, if it's set to some ridiculous OP setting like ultimate/high that doesn't enable any powersaving.
Intel is also known for enabling above turbo boosts by default, so they can cheat singlethreaded benchmarks, so who knows if that's enabled either. But most of the thermal issues can be addressed with a proper cooler anyway.
90c is "safe", but you def have cooler issues, and are probably running into thermal throttling, which will happen at certain temperatures. If the temperature ever goes CRITICAL, there are safety measures that will just shut your PC off, although long term temps will degrade the chip.
Side note: It could also be fan bearings, which most fans are replaceable on aftermarket coolers.

You can do whatever you want. If they try to enforce it, they're breaking the law. They only do this to scare people into not accidentally breaking their stuff, and make uneducated people think that a broken sticker means they can't get repairs, when they actually still have to honor it.
There's also ways you can remove stickers without breaking them, but I don't bother, since I know they can't enforce it. If you think they're shady enough to argue with you, print a copy of the report, and whip it out the second they try it.
