I think that penalty would be fine, but they'd need to add conditions to it or else you might have a bug where you pass out inside your house and get a letter saying someone found you, etc.
IF a penalty is added in a future patch, they should compensate by slowing down the clock. Right now it moves WAY too fast (like 1 tick per 0.75 seconds?) I'd recommend 1 in-game minute being at least 2 real life seconds.
We've seen the devs make changes recently to support different playstyles (like the advanced engine changes for players who aren't fond of combat).
Putting a penalty on staying out until 3am would not be consistent with the Devs tendency to cater to a range of playstyles. The dee-dee system already stops at midnight So if I'm ever away from town past midnight I just keep working until 3am. Having to walk home every night wouldn't be any more challenging but It would become a hassle for people who like to stay out late.
Keep in mind that while a letter from civil corps when you stay out late or a penalty of some kind might be fine for players who only stay out late occasionally, but it punishes the natural playstyle of some other people.
Personally for me, walking home every night would just be annoying as I stay out until 3am pretty often, so much so that the letter idea would mean my mailbox would be full of junk letters from civil corps.
While I understand some people might like more realism, is it really worth punishing other people who play differently to get it?
The penalty part was mentioned by other people.
Your idea is actually ok provided the civil corps letters capped at 1 and deleted after reading (or if it wasn't read within 24hours), most letters stay in the mailbox history even after being read so if someone who stays out until 3am every night got a letter from civil corps every morning it would become rather difficult to go through one's mail history.

Seriously. If you want to go to bed every night, go ahead and go to bed every night. Leave no punishment for passing out alone, and bring back my gliding horse!
Right now, it feels like a fairly strange thing to have in if there is going to be no penalty, and a monetary reducation is a bit pointless.
Let's say the Builder stays up until 3:00 a.m. and passes out. The next day, have them sleep in later, until noon or something, to make up for the sleep they missed out, and have all of their actions take double stamina, due to them suffering from the effects of exhaustion. This way people will have a reason not to and adjust their style accordingly. (Though, as time progresses and more stamina recovery methods become available, it's a bit of a moot point, but for early game it is more important.)
Or... for those (like me, admittedly) who will stay up until 3:00 a.m. when far from the workshop for that sweet, sweet free warp home? Remove that. Make it so, once the game hits 2:59 a.m., people cannot make any more actions and time freezes until they walk all the way back home. That way, people will start being more aware of the clock and try to hit up the Dee Dee Transport before it shuts down for the night.
The best solution, particularly for early game, is simple - if you stay up until 3:00 a.m., you have no stamina the next day. Your character is exhausted and any stamina you get, you have to recover with items from your inventory, or by spending some precious money for a meal at Django's.
I prefer that there is no penalty. I like that all we do is pass out and not get penalized for it.
The developers have already said they are not going to add penalties, so all of the people asking for it, can go play a game that does penalties and leave the rest of us with our No Penalty Portia.
I agree, Kyr. It is a very relaxing game and differentiates itself from similar types of games like Stardew Valley and Harvest Moon by not shoving a punishment onto the player for utilizing the day fully.
It wouldn't be such bad idea if time passed significantly slower, but at that rate of time progression it's nice to be able to fully utilize our days.
+1 for no penalties, please developers. ^^;
