whirling in rags theme vs Snowman · WYS 1 Am. Study Session
Look at the start of both songs:

They start with the same tune, is this common in this style of music or is someone ripping off another artist here?

Disco Elysium was released on October 15 while 1 Am. Study Session (relevant album) was released december 2019

As all of the songs in DE, as far as I can tell, are repurposed British Sea Power tracks that have been previously released, it is very likely that the song you linked above is sampling one of their songs. I can't remember which track of theirs is the Whirling theme, but I'm sure if you went through their albums you'd find it.

as a musician, those are two similar, but quite different openings. whirling in rags starts with a roughly 8 note theme(4 notes, then 4 notes), the other one starts with a 14(5 notes, then 3, then 6) note theme and is a bit faster, gives it a WAY different feel.

Of course they are not going to be a complete copy and paste. When I heard snowman I could not shake the feeling I had heard it before, then I was convinced I heard it in the game. Then I found the Whirling in Rags to be the match with the night version being the closest

With Snowman it's just that starting riff, and I could see someone coming up with that riff on its own or having heard something to that effect elsewhere in the genre, yeah. It's mostly just that one brief snippet and what is probably a coincidence with the instrumentation -- if not for the latter, I don't think it'd be noticeable.

it is like hearing 2 seconds of a mozart piece and 2 seconds of a schubert piece and thinking they are similar. of course, with the vast finite amount of music that exists, there is bound to be some slight overlap. maybe it was an idea that was used, which has been going on forever. maybe it was sheer coincidence, which has also been going on forever.
