Very black and white claim to make. Phylactery is a situational tempo-item that is extremely good on some heroes and useless on others. Take for example Skywrath Mage who can abuse the short 5 second CD of Phylactery which adds up damage throughout a fight but more importantly provides a long duration of 50% slow when totaled.
Jakiro however is unable to utilize the Phylactery hence why it is situational. The fact that Dagon does 400 damage doesn't in any way invalidate Phylactery. If these two do indeed become upgradable together, Tinker will return ready for DotA 7.33c.
