You both are right. On the one hand customers should always vote with their feet on the other hand the orginator has the right to stop other customers from misusing his content in a way that sheds wrong/bad light on it. I think even in Croatia there are copyright laws.
Instead make 2 Checkboxes in the serverlist
Checkbox [1]: Show server with Fees and/or ingameshops.
Checkbox [2]: Show only Official server and server applying "Scums fairplay rules" (You the Devs would need to definate)
maybe a third
Checkbox [3]: Show moddefied servers
Its not about alowing or forbidding, just about offering informations to the player he can decide what he want.
(Btw, you can add a additional checkbox that cant be set by the serverowner,

It doesn't. I have checked it some time ago. It is actually on your part but atm legal because you don't prohibit it via terms of use etc wich is a standard part of terms of use for online games but since you don't have terms of use it's allowed ^^
I don't actually care. Just want to throw in that you can disallow trading of digital good's because all virtual item's are property of gamepires. Not of G-Portal.
tbh personally idk if it's a legal or morale issue, but either way it sucks and the people that pay for such privileges are being taken for suckers!
I do recall a standalone site many months ago now (although i cant remember the name of it) selling many, many in game items for real $ (some long term Scum players will know/remember that site) which disappeared idk if it was taken down by the Devs, G-portal or they just closed it down voluntary, or due to legal issues etc but it was ran to coincide with a private server
imo such thing go against everything gaming is about and it's exploitation why even bother playing the game if your gonna pay for privileges?
Remember folks You's don't know who is actually run these things and sure they are doing it with other games and servers too so if your happy parting with bank details etc and get screwed over then noone is gonna refund You and you can't go crying to the Dev's or G-portal that you got screwed over.

In short many like their wallet to win for them but none likes for someone else's wallet to beat them. At most I think you can "not mind", and that's probably as a reasoning element because your prospectively engaging in the same behavior. The key difference in most being the direct competition element.
The Devs make money by selling Clients and maybe later DLC´s
They make ZERO money by people playing on official servers.
If people ask for money because it cost money to offer a server, let them.
It sounds as if you really believe people woule make thousands of Dollars only by offering a server. The reality is that most servers could be happy if they would yield the costs.
Besides that, its not just the servercosts. What do you thing is a 24/7 monitoring of a server worth ?
If you dont like pay to win, play on a server that not offer such things. Like we others do too.

underlineing the fact its 50$ imagine if that server per WEEK was making 50$ times X amount of people. if the server had a high population how much do you think that server owner is makeing per month if said service was provided at that cost per person per week ? and say there was 20 people useing said service ?pretty much just paid for the monthly service of the server and a quite a bit of profit. don't try to spin the reality of it. you pretty much paid for the game a dozen times with that amount you'd be paying each week even if it was 20$ per person its stupid rediculous. the fact remains you should never try to profit off anothers creations unless they specificaly said hey its ok to run a p2w server with our game. otherwise yea your breaching a business laws strictly in place to protect creators for that very reason.
But besides that, let the people play as they wish, and if people want to play pay to win, let them. Why would you join a server that has rules so far from all you can tolerate ?
