Bad Touch can usually only be acquired by a given character once (per playthrough), after which Moxxi will instead give a Good Touch when tipped (sometimes completing a story mission allows players to get another Bad Touch if they don't have any Bad or Good Touch in their character inventories). The only way to acquire a high-level Bad Touch is to either never tip Moxxi until Sanctuary reaches the desired loot level, or to have another player start a fresh character and join a higher-level player's game. Tipping Moxxi in the higher game will result in a Bad Touch scaled to the host's level.

At one time i tipped 400 grand before I got a good touch (i was tracking)
Well it dropped for me. I waited until I was capped to 61 to get it from Moxxi. Of course I don't use it anymore so I haven't tried at 72 with another character.
good thing i got a corrosive avenger from legendary loot midget today :DD
