The drop rate is "whenever he da*n well feels like it". :-) Seriously, I've read that bosses generally have a 1/30 chance to drop their designated item. I don't know if that's true, but it seems close enough. Sometimes it takes dozens of kills, or more, to get something. Other times you may be much luckier.
think this depends on either the item or the mob

As ShinkuTear posted, the level for dropped items is based on the enemy level. Mercy will be level 30-something when you start TVHM. When you complete the last main story mission in TVHM, everything in the main game scales to level 50. You can get a level 50 Infinity from Mercy at that point, but until then, his level won't change.
FWIW, there is a separate in-game trading section here in the forum. You could ask there to see if someone could give you an Infinity.
Actually, no. First of all, you won't even see Mercy at the Peak until you're playing in the mid OP levels. And even if he did show up before that, the Peak is fixed at level 35 in Normal Mode and level 50 in TVHM, so you can only get drops there around level 35, or around level 50, or higher. But, like I said, you won't even see Mercy there until you're playing in the OP levels.
Yeah, some seem to have different drop rates. But the other thing with bosses like BNK3R is that they have more than one designated drop. BNK3R can drop special heads, or a Sham, or a B!tch. It makes it that much harder when you're looking for one specific thing, like a Sham from BNK3R. When he does finally drop something, it could be a head or a B!tch.
