But if he does, let's consider the contracts. The Medic clearly has an advanced knowledge of his soul contract, so we can assume he had a part in writing it, otherwise he would have to hope the Father of Lies left an accidental loophole. Not likely.
It would not be a stretch, then, to assume there is another loophole (left by Medic). Without seeing the contract, we can not be for certain, but the dialogue seems to imply ownership of a soul is linked to the soul itself and not the original owner. Satan and Medic talk about selling souls like selling cookies. Consider you had a cookie, and sold it to a friend. If you gave that cookie to a third party to hold, would not your friend still own the cookie?
The very little information we have and a reasonable assumption based on the legality of object transfers would lead us to assume that if Medic were to implant a damned soul to a new person, that person would be damned. The Medic would then not have that extra seat on his Board of Soul directors, but he would have one less seat controlled by the King of Demons. We also know the Medic is ruthless (to some extent. the comics show he has little regard for other people's personal safety), so damning his friends to hell would not be out of the question. However, he is very smart and probably would not do so unless he had a way to get them out of it.
Therefore we can probably assume in the TF2 universe, that unlike ribs, souls grow back.
Which means if Medic did transfer the souls back to the original owner that the owner would now have two souls in the same way that Medic has nine souls.
You've just blown the lid off this souls case.
Also, I would say the original owner doesn't matter until Medic puts the soul in.
Say the Soul he sold was originally Scout's, but he surgically adds that to Heavy. Heavy would then have the sold Soul.
God is very clearly a fan of Scout, so if Medic gives Scout a damned soul or Scout himself sells his soul to Satan, will God override that contract so Scout can go to heaven with him? Or will he begrudgingly let Scout go to hell?
YHVH hasn't shown any signs of being into stickytraps. He might be scoutsexual, but anyone with tastes would be.
