And since VRChat doesn't give bans without you being reported and proof gathered. Then that means the original avatar creator found out and provided said proof.
Id say you should take that advice. Use public avatars or pay for/make your own instead of finding them for "free" online.

There's also plenty worlds in VRChat, such as Avatar Museum and the recently released Booth Cafe that showcase avatars with a wide range of prices if you're looking for something more bespoke and have some money to spend.
Cloning avatars is 100% fine. That means those are public avatars and the uploader made a choice to make them so. NO ONE will EVER get punished for using a public avatar, unless they abuse the hell out of stuff like NSFW or a crasher.
And even if those public avatars are stolen. Then their uploader is the only one to get punished if need be, No one that uses those public avatars should ever have anything happen to them outside of finding it gone one day.
Private avatars on the other hand. That's on you as you was the one to find a "free" copy of the avatar, you was the one to upload it knowing you did not own it, and you was the one using the thing. So if you get caught with a stolen avatar on your account then you earned punishment.
But, the odds of getting caught with a stolen avatar is really freaking small! And proving it's a stolen avatar is extremely freaking hard unless the original creator themselves makes the report and provides their own proof as the VRC mod team has no way in hell of proving that any avatar is stolen without the original creator saying so.
I can't support using stolen avatars. But at the same time I don't really care. And if someone does manage to get caught with a stolen avatar and get banned for it, then they simply earned it in my opinion as the odds of someone getting caught with such a thing is just low.
