Can streamers on Twitch be stopped pre release?
The game is set for release on the 10th, and a guy is playing and streaming on the 6th, is it not possible to have the person forcefully stopped from streaming a game that was leaked to him?

And, finally, thanks to mr real lawyer here, we have our answer anyway - its against Twitch's TOS to stream games pre-release. I'll give him the benefit of the doubt and assume that's correct.

So all Bethesda's lawyer has to do is call Twitch's lawyer and show that they own the IP and that a specific streamer is streaming it pre-release. Pretty trivial, doesn't involve copyright or civil suits at all.

And then do that every 5 minutes for the next three days as new streamers pop up.
Twitch can stop it in good faith if nothing else. After all them having a good relation with software developers is - well - good. If Bethesda asked them to. I am sure that they would put a stop to it. I don't personally care about this. I can avoid this. What I can't avoid are ending purposely put in titles to troll. That pissed me off last night. Was just about to purchase from GMG. Wanted to look into pre-loading. There it was...

Nope.

1. Gameplay footage is not copyrightable. Meaning you can't (legally - Nintendo, looking at (you here) use a DMCA notice to get a quick take down.

2. Violation of an NDA is a *tort* - which means civil court. No police involved and no obligation on the part of Twitch to do *anything* until a judgement is handed down. And Bethesda is as likely to get a preliminary injunction as Todd Howard is to walk on the Moon - possible, but I wouldn't bet on it happening.

3. Nobody streaming signed an NDA.

So, there's no *law* being broken, no *tort* being committed. Bethesda doesn't have a leg to stand on as far as stopping streaming goes.

Now, that said - Twitch *could* out of some sort of misplaced fondness for Zenimax Media and dislike for its own streamers (you know, the guys who *actually make money for the channel*) take it upon themselves to block the streams. But why would they? That would piss off their streamers, which would piss off their advertiser, which would see their magic money tree disappear as fast as Reddit's did when Pao was CEO.


Actually you should get your facts right...

#1 But since its not out yet their accounts can be banned for you playing before release..
that includes the system you are playing on and the twitch account its on.

#2 Game companies have actually sued people before for streaming their games early as well as the Supplier gets a hefty fine.....
#4 Nobody signed a NDA but still its the fact the game is not due out till the 10th unless they say otherwise... So streaming or even playing it before that can and most likely will get their accounts banned.... Is playing Fo4 3 days early worth having to pay for a new XB1 or PS4 account and well as restart your twitch account??

why would bethesda care hes promoting the game and gaining more sales out of it its just 1 streamer the world will still go on

pretty sure in twitchs terms and conditions when you make an account for streaming you agree to NOT show games before release... so twitch can, and do, shut down channels and ban streamers for breaking that term/condition

hes been streaming for hours they didnt do anything though so im sure hes safe
Report them and move on.
Lots of people on steam have an entitlement complex, it's best to just report the streamer.
I'm sorry if the early streams rustle your jimmies, but it looks like the stream was never banned.

Why would yu stop them ?
The floodgates have been opened, either you ignore those streams and spoilers flying around or you try to presure Bethesda to release the game early.

If enough people complain and cause a ruccus they will budge just like with the payed mods issue.
