Anyone knows why the final Judgment weapon is not on elder maxon in the quest airship down ?

He doesent even have it in his inventory( i even checked with console commands THATS BEATHESDA STYLE )

He drops it on the ground next to his body before you get to safety. (basically it's not in his inventory but is unequipped when he dies and then dropped)

what i mean is that i accessed his inventory right as he spawned in the vertibird an he only had a leaser rifle

Don't you have to kill him as part of one of the other faction's "Kill the BoS" quest to get it properly?

You can get the Quest to destroy the Bos from The institute( airship down) From the minuteman( with our powers combined) or From the Railroad (Rockets' Red Glare)

Yes, and I think it doesn't spawn until you fight him during those quests. If you kill him outside of them, or maybe not I can't remember if he's marked essential, you don't get Final Judgement.
