Most of the assests for Fallout 76 came from FallOut4. As long as they do not try to use "copy righted assets" as in trying to import thiong in 76 that are not in 4, but if they recreate that asset than there would be no legal issues.
And Bethesda did not sue them. They just could not give permission to use character audio for legal reasons of thier own, and the modders did not have the resources to hire their own voice actors.
F76 would not be the same without the voice acting & the holotapes.
If you just used he F76 world. Oh, maybe just add the npc's from fallout 4? I dunno.
This wasn't Bethesda Suing modders, this was Bethesada warning the modders (See; Saving them from being sued) that it is illegal to use Liam Neeson's contribution without his permission for a new Software product.
Bethesda, tmk, only care about keeping their voice acting in the game that it was created for.
If a mod team had their own voice actors and used a potion of the existing voices from the old world, that would be amazing.
Think of it as a Orderly Chaos-Chaotic Order kind of thing. They sound like they would be identical, but once you look into it they're drastically different.
Short version: It's too risky converting new assets into an old game.
As for why FO4:TCW was shutdown, is because porting FO3 voice files via a program won't work. FO3 voice files are packaged and organized differently than FO4 files, making them impossible to read by the game. While a program could convert those files, it would simply be too risky. If the team directly downloaded the files and packaged them into the capital wasteland download, then they'd HAVE to be sued by Bethesda. If Bethesda didn't, anyone would be allowed to use FO3's voice files.
TCW also wasn't just shut down because of the files. There were a LOT of internal issues going on, such as Patreon money and general organization. TCW team had the option of creating their own dialogue (As every other team is now doing, like Skyblivion and FO4:NV. Skywind got lucky because Morrowind is almost 99% text), but chose not to.
So think everything about FO76 *except the multiplayer* in FO4 would be awesome? Then why not play FO76 by yourself?
Because you can't. It is 100% MMO. The number of players per instance may be small but you are still playing with other people.
That is actually incorrect.
In reference to this thread it would be wasted effort as private dedicated servers are going to be a thing.
Meaning, if youre intrigued by the game yet have a serious fear of ever meeting other human beings, those private servers would be a solution.

Also, yeah, it's just "Online", not an MMO.
There are no "MASSIVE multiplayer" encounters.
I get the term has been watered down a lot, but it's nonsensical to use it this way.
If we start calling games that contain 20 players on the entire server "MMO" already me we might as well give up on the term.
