Report a translation problem
I have it in my current campaign which was started with the new DLC in beta. I think it's the event that's uncommonish, if you make all the right choices you should automatically get it. I mean, based upon the three times I have acquired it.
I like it though. It's better than one might expect in terms of getting enemies to flee. I put it on somebody with excellent morale, typically a tank, and it's the hits/surrounds from the other guys that cause the fleeing.
Ha yeah, I was unequipped too. Had my nimble archers tanking necrosavants... but everybody survived, barely.

A question. If I give it to somone who is Determined does the skull or determined take priority?
Probably the skull as a guess but have not tested. The skull would have no disadvantage on an insecure merc, since he can't be confident anyway.
Screenshot of dialogue and loot from fight? Could be a bug. Some people have confused the caravan necrosavant event with this one, but you probably wouldn't.
A flag for the crystal skull is checked and must be set to get the item. It has 50% of 5% chance to be set and only if your business reputation (Renown) is over 700.
So you could indeed fight the battle and not get the skull. You cannot get the skull twice.
