There have only been 6 or so cases in the US where a EULA has been thrown out as unenforcable due to restrictions placed on the end-user beyond the power of the software provider to enforce. Otherwise they are generally accepted to be valid and enforceable.
The one that comes with RL is pretty standard with those that have been formulated since these rulings and you can guarantee that Psyonix have taken advice from legal proffessionals that are well grounded in the current IP landscape.
By all means, if you want to test them on this go ahead, but I doubt it would be profitable for you to challenge it.
I skim-read some of it and it all looks OK but I will be mad if tomorrow I am taken to an underground lab and made into a human cent-i-pad.
Ditto, seems like ♥♥♥♥♥♥♥♥.
Pretty much all of section 7 is a problem, but in particular the following highlighted parts are seriously ♥♥♥♥♥♥:
By installing and using the Software, you consent to the information collection and usage terms set forth in this section and Psyonix’s Privacy Policy, including (where applicable) (i) the transfer of any personal information and other information to Psyonix, its affiliates, vendors, and business partners, and to certain other third parties, such as governmental authorities, in the United States and other countries located outside Europe or your home country, including countries that may have lower standards of privacy protection; (ii) the public display of your data, such as identification of your user-created content or displaying your scores, ranking, achievements, and other gameplay data on websites and other platforms; (iii) the sharing of your gameplay data with hardware manufacturers, platform hosts, and Psyonix’s marketing partners; and (iv) other uses and disclosures of your personal information or other information as specified in the above-referenced Privacy Policy, as amended from time to time. If you do not want your information used or shared in this manner, then you should not use the Software.
For the purposes all data privacy issues, including the collection, use, disclosure, and transfer of your personal information and other information, the Privacy Policy located at www.rocketleaguegame.com/privacy, as amended from time to time, takes precedence over any other statement in this Agreement.
Edit: also you can report it to EFF at https://www.eff.org.
