It made no sense that their allies would allow someone to run off with their friend, so it was made illegal. It's not really a feature, more a counter to an exploit.
Edit: Also, in the future there is likely to be ransoms. But this is not implemented currently.
Another counter might be that the allies chase down the player who picked up their friend, and the player incurs a bounty.
With the current implementation, just picking up an npc (as opposed to kidnapping) is not so much "illegal" as it is impossible.
Since kidnapping replaced "pick up" on apparently anyone who is not a faction member, there is no longer the option to just help neutral npc's (e.g. put them in a bed to heal).
I'd like to have the option to choose to either kidnap or simply pick up and carry a downed non-enemy npc.
I noticed this too when I was desperately trying to help a hive village hold off a deluge of beak-things, I couldn't get the fallen soldier drones to safety (out of eating-range) without "kidnapping" them and turning the village hostile.
Then he started working on my campfire and iron, which puzzled me. Will someone come and free him (he IS tagged as kidnapped) or is it a 'debt' he's paying back? I think it's not a bad thing, but strange (maybe use another label instead of kidnapped).
I was in disguise and was able to just walk out of the town with their main man on my shoulder. Also, now he is held in a locked building in my town, where I fist fight him, but he doesn't seem to be angry about it. You can even talk to him, every time after he or I get knocked out. Also, he stops attacking once I change my weapon.
Some sort of realization that they're being help captive on the AI's part would be great :)
