There is a way called single-use-saving. Any save can only be used once and there will be only one in battle saving slot.
This has been done before and still be used.
I guess they don't have enough money to buy a share copyright?

We should be thankful that XCOM:EU kept so much features that are/were openly judged as obsolete by most, if not all publishers.

The game surely has flaws, but it's open to modders, who are probably going to come up with an original UFO:Defense clone mod soon enough.
What is the point of smearing it for details that only matter if you play in a very specific way, why not just try to adapt ? Just keep in mind that people will come up with "fixes" for you playstyle soon enough anyway.

Sure they do and sure there are. This is just the method they chose to go with. When you feel up to coding your own game feel free to use whatever method you decide to implement. Just cause you would have used a different method doesn't mean your say is better than thiers. They made the game. You didn't. If you don't like the games design, then don't play it.
