That said, it's just a new genre is all.

I get the whole doing it because the other games did whilst making it your own hence why we got things like Doom, Unreal etc but don't literally shoot yourself in the foot with "Yeah it's the same but waifus"10 Mins till dawn is quite good also ngl.
Infiniminer gave us Minecraft. Doom clones spawned a lot of fondly remembered games, and eventually inspired new sub-genres. Virtually every beloved game took mechanical or other inspiration from something that came before it. If a clone is blatant enough of course, then there are avenues of recourse available to creators. But beyond that, it's just how it's always been. And proving a work is derivative can be challenging.
This is why we have IP, patent, and trademark laws to protect likenesses, unique ideas, etc. but rarely any enforceable means of protecting genres or broad, amorphous concepts. No one really owns a genre (thankfully, so far) and the problem is, games that are distinct feeling tend to end up creating genres. (Such as the Battle Royale online shooter sub-genre you alluded to by referencing PUBG.)
This has always been the way of things. The particularly blatant or low quality clones will get largely overlooked (or if they infringe on IP will get taken out if a creator has the means to do so,) whereas those that add something people find compelling or - more often - an innovation that is transformative to the design, will spawn further sub-genres. Think of it as generational evolution, or a family tree.
Though, some companies have begun trying (and succeeding) to patent game design systems (notably Warner Bros. with the Mordor series' Nemesis system) which I suspect may cause problems somewhere down the road.
I see no problems here, they've bought assets like Vampire Survivor did apparently and it even have "a plot" it seems, so it's not a clone especialy since that one contain adult stuff and look way better than VS.
