Some people don't like thieves. It was marked stolen right? Little Red thing. So when you picked it up you stole it. Simeon says....That's not right.
If you are asking about the cave, its part of an encounter. See a Miner spawns near by and says its their mine. But sometimes they don't spawn on your side of the mine or it lags the spawn and you don't get the encounter until you come out or one of multiple variables.
The actual issue is inherent in At least the last 3 Beth Games. There is a generic faction they like to stick NPCs in that will cause them to attack you if you do something they deem as wrong.
No matter the logic of the situation, they will still attack. Smack em down and see if he comes to his senses (Pretty sure you can't kill em). Worst case scenario they leave.
Simeon also should not be in any mining faction to be offended by something like that.
The game generally has problems with detecting hostilities, so you always have to take the first hit before you are allowed to defend yourself.
So in other words NPCs are allowed to draw a gun at you and shoot first, but if you don't want that and shoot first it counts as murder.
