So is Valve actually actively optimizing olders games to be playable on Steam deck?

Not just checking to see if unsupported games are playable on their own but actually making them work? Is there an example? I would like for Nioh 2, Zone of Enders 2 and many others with video problems to be playable eventually.

It's up to the dev of the game to make them playable.

Have you looked up your titles on https://www.protondb.com/ ?

That being said, there will still continue to be changes/enhancements to Proton but that won't fix every problem with older titles. Some titles will never work unless the developers themselves make changes (which is likely not to happen if the title is really old).

It's the other way around I think. They are trying to make it so the SteamOS is compatible with older games. And I'm pretty sure it would be a violation of copyright law for them to mess around with the code in older games even if it was just to make them optimized.

Exactly this. Valve is actively developing Proton to be as compatible with running the games as is possible. That said they have no access to the game code it's self to make sure the game can run as is needed in it's specific case.
