I've changed all sorts of settings both in and out of the game but I can't seem to get higher than 40 fps. any ideas?
also I'm bothered as to why the ship ALWAYS appears tilted when you're on the helm

The optimization is very very bad. I play with a RTX 4070 and got only 50 FPS in the game

It doesn't happen for me. Maybe try turning off ship sway in the options and see if that changes anything.

Is there something wrong with the 4070 card wrt this game? Second complaint about using a 4070 card in 10 minutes. Hopefully someone can help you set things right. No help for you but, for me, the game runs okay using an antique 2080 Ti , except during elevator lift travel up and down when it stutters a bit. Your card should be way better than mine so maybe the problem is not the game itself (although I'm currently stuck in the game myself due to some development glitches). Who knows, such is the way of early release games, so I'm just going to wait ... I have no other choice. Perhaps the developers will fix your 4070 issue when I can use the underdust lift again too.

doesn't help, as soon as I'm on the helm the ship appears to be tilted. to the left side of the helm

if framedrops are an issue. I found that changing the graphics API helped IMMENSELY. the underdust transition is still insanely laggy but when your just flying around or in the underdust there's no longer any frame drops
