Neither of you have stated anything about your situation so for all anyone else knows it could be as simple as still being on Windows 7/8 or just really old hardware that is being left in the dust by Steam updates. There is a reason they warned everyone for a year to make sure your system was some what up to date for all of Valve's plans moving forward.
You could also be running some other add-on or overlay that when triggered by the steam overlay causes battleye to close the game.
Across 4 different pcs running 3 different operating systems I never had a problem with the Steam overlay, I only disabled it on the oldest PC to squeeze every little bit of performance out of it.
