then its clearly a bug, since you can use fear trap even on ally

It's a bit inconvinient, but that's how.
For traders, your best bet it to keep your eyes open, and scout for them. They always travel between neutral and friendly tribal settlements.
Once you find one, run ahead of it's route, and plant a trap when none is looking.
At one point in the game, guards start escorting the traders and gatherers. If you are careful and lucky with your trap placement, you can get more than one scroll at a time.
Also a good time to get scrolls, is during or after a battle or raid. Any creature drop their scrolls, even if they aren't killed by the player.
