Wife stuck in Bariyye after being captured in battle

My wife was part of my band and after I lost a battle she disappeared and I eventually found her in the Castle of Bariyye, when I tried to interact with her it showed the "Surrender or Die, make your choice" text. Any way to fix this?

Solution: I got the new patch and started a new game and the wife now stays with the party after defeats!
