I believe John Szymanski is working on a fix. He wants it so that players of the Free Edition can access all the endings they used to be able to get in the classic edition's non-DLC content, but as the ending tied to the broken phone (and it failing) was introduced in Kyle is Complete there are a few issues.
If you're able to access all the New Phone endings from the start then that is probably a bug as well. I can point these issues out to John Szymanski, though I expect he might already know.

Yeah, I can confirm what Zhoggo said, Free Edition can't access the "Not Helpful" ending, you only have the "New Phone" option (even though I haven't even done a single Detective ending yet). It seems like it is indeed bugged. Not unlike the Bug Vigilante!

Zhoggo it sounds like you've encountered a bug. Getting the New Phone should not lose you the options tied to the Broken Phone.
If you are in the Free Edition then I did hear John Szymanski was trying to make all the base-game endings available to new players, but in doing so had broken the Wasn't Helpful ending.
Are you in the Free Edition?
Either way, I recommend reporting this in John Szymanski's Discord server. He should be able to help you more than I can.

the was famous/final ending one doesn't seem to work? i did everything to a T and it still continues the interview as normal and doesn't give me the police option :(
