The story is that Krafton decided to fire them because they wanted to prevent a potential problem. There was a risk that the expectations for the EA1 game could damage the Subnautica IP if they released it with only 12% content right now. Krafton claimed it could cause irreversible harm to the IP, and they weren’t willing to take that risk. It’s all actually documented in their own filings.
Krafton's main defense almost always seems to boils down to the relatively simple sentence " to which defendant respectfully refers the court for its complete and accurate contents". Meaning. "Judge don't believe UWE's spin. Just read the original contract. Personally I find that very intersting. Krafton don't even seem to be interested in arguing their point of view 90% of the time.

There's only two logical conclusions to this that I can think of.

a) Krafton's lawyers are confident enough in what they negotiated in the contract for the judge to side with them purely by reading said contract. They don't need to add any spin, they feel like the contract read in it's entirety favors them on it's own.

b) Sheer hubris and incompetence. They're caught with their pants down and don't even know it, wasting a valuable chance to defend themselves against UWE by relying too much on a document that's not as strong as they think it is.


Both would be possible. But I'm more inclined to believe a) which means that UWE's lawyers are indeed overpalying their hand, attempting to win in the court of public oppinion to gain leverage in a settlement later down the line and Krafton know this. This isn't their first studio accquisition and they get sued all the time so this is not their first rodeo. As a result the "incompetence explanation" seems less likely to me.

You are of course free to agree with me on parts of what I said or all of it and, if you feel like, come up with your own explanation that could explain Krafton's line of defense.
