Multiple notes here. "control the launch date" and "set the release" are not the same thing. This is some very peculiar wording from UWE which I would most definitely follow up on it if I was the judge. Or well, just read the contract Krafton generously provideddd.

The next imteresting thing is the violation of the feduciary duty. That's a pretty strong argument that, if proven to be true, would overwrite pretty much everything else. I can definitely see a case for UWE acting against the interest of the company maximizing profits by pursuing a suboptimal launch strategy.

And finally I think Krafton threatening to take over operational control is interesting too. What does that tell you about the powerdynamic of UWE and Krafton if the latter can take all control away from the former?

You're missing the Forrest from the trees as you usually do when confronted with information that contradicts your assumptions. You're making a distinction without a difference. Krafton objected to UWE reminding Krafton the launch date was UWE's call, not the publisher's, as set out in the contract. It could not be stated any more clearly there.

The fiduciary duty isn't even an argument. It's Krafton scrambling to find anything in the contract to get around the fact that they did not have the authority to dictate the launch. How do you threaten to "take over operational control of Unknown Worlds," if you already were the one calling the shots in the first place lol?
