Your post went beyond online. Anything that's takes place offline is considered government responsibly. Yes, United States does regulate video games just like any other countries.
I'm guessing you aren't American or aren't aware how the courts in America work.
Of course the constitution doesn't say it, because videogames didn't exist back then.
But the supreme court says "The U.S. Supreme Court has explained that video games are a form of expression entitled to First Amendment protection."
And that means they are legally protected under free speech in the U.S.A. just like movies and TV and other things that didn't exist 200+ years ago.

The rating system was created because DINOs like Joseph LIEberman were allowed to tell easily verifiable baldfaced lies, and nobody was willing to correct him and throw him out of office on his ass. I voted Green party in 2016 precisely because those lies are the one thing Hillary Clinton was actually guilty of, and now, ♥♥♥♥♥♥♥♥♥ are ignoring that Trump's cronies told the same lies and are somehow claiming he'll be good for gamers, because of crypto or some equally ♥♥♥♥♥♥ nonsequiter.
Exactly, I don't know why the other user claiming no regulations or censorship. I am American citizen and knew this. Rating system is part of broad regulations for gaming.
If there were no regulations as the other user claims, then why not have CP in the games? It's clear the other user either misinterpreted the laws, or didn't know.
Other than that, a complete ban it's going to be a futile lost battle like the alcohol ban was back then.
Perhaps there are not enough studies? Although I'd argue that the porn industry is far far more powerful than the tobacco industry ever was.
