Then the same logic applies to the tree that fell. We can assume it does make a sound because why wouldn't it?

You just said he dies... So, yes, dead... You have to leave out such obvious information to make a proper trick question.
If you lead by saying "A person dies" you have already told us the answer to the question of "Is he dead?". The only way that one could go other than "Yup hes still dead" is "Who is HE? and is HE the same as the PERSON that dies?"
As for the tree falling, it leaves out enough information that it could be taken all kinds of different directions, everywhere from asking if it means "Fall" as in the time of year (does fall make a sound?), or how far it falls, or how would someone even know a tree falls if "no one" is around? If someone leaves a video recorder in the forest to capture the tree falling and the sound it does or doesn't make, does that still count as "no one" being around?
It is basically a critical thought trick-question.
Yeah, did you see that Chanel 4 program Spies. They gave every one a gun and blindfolded them, they said there is a threat in front of you and you have 30 seconds to asses whether to shoot or not. Only ONE person actually asked any questions that would be used to assess the situation. All that went through the minds of the others was "threat" but they did not say they were in "imminent danger".
