The board will reboot until it finds overclock timings that work. It should retain the settings, once it has figured them out. Or you could try setting up the memory manually.
Buy good ram... Corsair, Gskill or Crucial. And stick to 3200 @ CL 14 if you can, which is faster

Plus returning the ram isnt an option. im just seeing if there is a permanent fix or work around for it not always posting.

Positive. Even though you have been the only one here that mentioned 2666mhz. So even though you might be the morally correct person here i will just keep this open a bit longer seeing if there is a work around. As before i did it through XMP it was booting fine and running at 2666mhz until i used XMP to allow the ram to go at 3600mhz. Its not like i cant use my computer or play anything on it with unstability. it just it wont post all the time. First boot up it just shows an infinite black screen and i dont hear it post. I hold in the button to turn it off then turn it back on. Then it shows the Americatech screen then i hit F1 to go to bios. After i hit save and reset it will boot up normally to windows.
Don'y worry about it your doing everything as well as your able too. There is no permanent fix for it. You will get failures to post but it wont effect your performance. The motherboard will and can run up to 4200mhz ram. ITs just the processor isnt made for it. As long as your using XMP you will be fine. The annoyance wont ever go away and i havent found a work around for it. But i do know it will work fine and the failure to post is it searching for Timings. So in therory setting the timings manually might fix it but going through all them numbers even for me is to much. So just keep doing what your doing, your fine!
