This would be a sorry excuse as sneaking would be gameplay also in itself. Done right it wouldn't mean that these is a prefect or teacher at every turn but just one patrol in each wing of the castle would be enough to keep you on your toes. This is gameplay, making things adventurous... in an adventure game.
Also you are not forced to play at any time of the day, the game allows you to skip day to night and night to day. So if you don't like having to sneak at a time where as a student you are supposed to be in your bed you can still change the time of the day.
Yes, it's not allowed to walk outside your common room in the books/movies at night.
....but the game is set before the books/movies. How do you know that the same rules existed 100 years before?

I'm more confused about the fact that the cloths of the students don't change during seasons. People walking around in thin robes in the middle of winter like it's July. That was extremely immersion-breaking for me.
We know it was illegal in Harry's time, and his Aunt Petunia complains about his mother coming back in the summers from Hogwarts and, "turning teacups into rats," and such. Which implies it wasn't illegal in his parents day, but then in Legacy it's stated as being illegal.
Anyway, back to topic: Yeah, I think they missed an opportunity to have things to do and/or places you could explore only at night, and have them require the player sneaking about after curfew.
On the other hand, having to go back to sleep in your dorms every 20 minutes or whatever the day/night cycle is would've been irritating. Probably better to make the time only change when you rest in your room or as part of quests if they had made curfew a thing.
Actually late 19th century. Yeah I bet that during the Victorian era discipline was lax for kids, even young wizards at their school...
You know very well when you wrote this that the interdiction for students to wander in the corridors at night also had to apply back then. There is a reason why you are not seeing a single student in the corridors at night.
Even this game, which has for once correctly identified that a spin-off should probably focus on adventures in the beloved magic school that's central to the series, doesn't really get that the "school" part is just as important as the "adventure" part.
The game should have been Bully but with magic. Not just in that it had a schedule and classes- though it should have- but also that the plot should have centred the school.
I actually think the opposite. It's already too much school for me. However, I'm not a hardcore Harry Potter fan. I just think, it's fine. So, you are probably more right on that, if you are truly into the franchise.
