I don't think we'll be killing people until the late game. We are playing catch-up with all of our peers because we are starting Hogwarts late and need to learn magic in a make-up course.
The trailers show Sebastian offering to teach us the cruciatus curse, so I think it's safe to say we won't be able to cast dark magic until we actually learn it.
I'd keep expectations on the "can't use a spell until we learn it, and the more powerful spells may be until late into the game" sort of thing.
ah.... sucks but oh well
Watch the Dark Arts trailer. I'm pretty sure it's going to have an affect on the story.
