It wasn't union issues with Viacom, it was budget and time constraints. One of the original developers Lyle Hall, lead project manager at Heavy Iron Studios, let me know on email that they couldn't get Clancy Brown because the amount of voice work they needed for Mr. Krabs, didn't work with their budget to pay Brown at the time and to make the deadline.
By the time the first Spongebob movie game came around, Lyle said that they had a bigger budget when Nickelodeon came to Heavy Iron Studios again and thus was able to hire Clancy in 2004 for that game.
Also I heard that Nickelodeon doesn't want to redub the English language but don't know why.
