Sure it legal, doesn't make it ethical. I had previously stated it was unethical. and its legality doesn't mean it shouldn't be critiqued.
Also Ninja Kiwi is from New Zealand and their Privacy Policy confirms it. They are technically owned by MTG, which is however from Sweden, therefore part of EU.
But I am not a lawyer, so there might be some shady lawyerspeak, I might have missed.
That being said, this feels blown out of proportion, as from available data it seems that worst offense NK did is that they didn't test their anticheat properly, so it produces some very funny false positives. It seems they are just checking running processes against some wordlist, to see if there are matches.
It might be nice to do some thorough analysis of what it's actually doing, but since the process works even in full offline mode, it probably does not even send the data anywhere.
