how come Ajax's Spear isn't classed as a Legendary Weapon?

The reason I ask this question, is because before I got into modifying the in-game weapons/shields and the like, the few times I farmed Commander Ajax in the Knoxx DLC, a couple of those times he dropped a version of his weapon that spawned with the Atlas Ogre accessory, basically turning it into Ajax's Ogre.

even on Borderlands Wikia mentions that his weapon will occasionally spawn with this accessory, giving it a x3 Explosive accessory (and on ultra-rare occasions, x4), making it extremely powerful.

It's classified as a unique item, I think, so it can share the same power level or effects as a legendary without having the same value or classifacation.

ah, thought so. because according to Borderlands Wikia, if the Ajax's Spear spawns with the Ogre accessory, despite it being a unique weapon, it can pretty much match the explosive power of the legendary Atlas Ogre (had modded both an Ogre and the Spear w/Ogre accessory to dish out 461-Damage at Lvl-69, simply by giving them both the "Shattering" prefix [and that's with a fire-rate of 12.5])
