Open Borders
When negotiating peace how to I get Open Borders as part of it? It says I have to already have an embassy with them, but since we are at war I don't and if I include it as part of the negotiations it isn't enough.

Yes we both have Civil Service. I have had Open Borders with other Civ.
I am asking because I have seen other Civs fighting, then when they make peace forces from 1 side remain inside the territories of the other side.

The more desperate your enemy is, the more they will give you to make peace. Likely, they aren't beaten down enough to want to give you open borders. Either keep pounding them and taking cities until they are desperate enough to give you everything you want, or make peace now and keep trying to win favour with them with things like: voting for their world congress resolutions, trading resources, and denouncing and/or going to war with their enemies. You could even ask for this from them in order to fight someone they are already at war with.

If you call up the screen where you can view all of the civs in the upper right, scroll over their names and you will see a list of good and bad things effecting your relationship with them. Until there are more green good things than red bad things, they won't want anything to do with you.

Finally, ask for open borders and when they refuse, click the button asking what they want to make the deal fair. It might be they just won't go for it, but you'll get an idea of how far away they are from agreeing.
Killmeister you missed the point, I AM NEGOTIATING PEACE, not just trying to make a trade. I am not given the choice. Or can only the AI do this and not players?

In that case the issue is the embassy which you must have first in order to get open borders. You can't do them both in a single peace deal. You need to get the embassy first and then come back after that deal is done to try for open borders. I'm not sure why the AI can do it. but you definitely can't.
