CS:GO overwatch system broken?
So there are theories out there that once you get over watched you are most likely going to get banned because people who have overwatch just skip to the end and prosecute for hacking even if they where legit just to get the xp. If this true?

No. This is very stupid. Saying people are cheaters doesn't give xp, getting accurate judgements gives xp. On another note, xp is almost pointless so it's not even close to a reasonable incentive if overwatch worked that way.
Your theory ignores the facts about how overwatch works. If you just convict everyone your overwatch score will be extremely low and won't count on the cases you watch.
No, it is not true.

Do you honestly believe a system implemented to convict cheaters, for a game hugely popular and profitable, along with one of the leading eSport contenders, could be this flawed? Those that do what you said in your OP will not be Overwatching for long.

How are investigators scored?

An Overwatch score represents an investigator’s ability to consistently and accurately judge the evidence they review, per charge, in both real and test cases. Investigators score positively for agreeing with the majority of other investigators’ verdicts for the same replay, and score negatively for being in the minority. The resulting change in score is larger when most investigators are in agreement, and smaller when they disagree. Because of the occasional test case inserted into the case load, the only way to improve an Overwatch score is to carefully watch the entire replay and make an informed and accurate judgment of the evidence provided.

Yes. A higher-scoring investigator’s verdict will carry more weight than a lower-scoring investigator.

There is a reason why bans are hardly (and by hardly, I mean almost zero) ever overturned. It is not just one guy at Silver 2 in Overwatch calling the shots, like many convicted cheaters claim in their threads when they cry about being unfairly banned. Many people will be handed the same case, and I imagine in some instances, it goes much higher up the chain and internal judgements are made.
