Should you technically have a surprise round? Sure... does it really matter? You still kill them easily. Heck... usually the two halflings kill them before my main character can get a shot in... unless I'm doing the higher difficulty, then I get a few shots in until they die.
I'm not serious about the unfair difficulty, but it does irritate the hell out of me when obvious enemies are marked as friendly before a fight.

No, they are not easy on Unfair. They're pretty early on, so go ahead and try them out, they steamroll your party if you're not using a caster with sleep.
I think you're thinking of a different fight. The two you fight when you meet up with Linzi and Tartucio, are in fact extremely easy on every difficulty level; I'm not sure they even get bonus stats on the higher difficulties.
