if you walk into the rat mans area there is a radio playing a song

this should be included on the DLC not sure why its not

that should not matter its still a great song and clearly used in the game its even listed during the credits

Yes, because Valve asked a band to make the song for them.

Of course if they use the song in their game, then they have to credit the creators.

And since the creators own the song, they can restrict Valve's use of it.
They wanted to sell the song, so they decided that Valve can't use it for the soundtrack DLC, and released it on its own.
