They didn't fix it in the patch..
Worst is chaos. They can't even defend the settlement to prevent it changing hands. As others you can atleast do that.
Why can’t you defend the settlement as chaos? I like one man army campaigns and I’m doing one with Aranessa now where I’m just sitting off the coast with a doom stack and killing anything that gets near the shrine and my dark elf allies while aranessa runs all over the map. Seems like with chaos you would be enemies but you could keep someone trapped like Tyrion trapped in there and kill him if he tried to leave the settlement (his last) but you would also have to protect him if someone came after him.
I don't know the lore revolving around it but it's still a physical item, if the elves made a rite to magically bring it back then maybe, but that isn't the case.
Imagine lorewise that Malekith was holding the sword, then all of a sudden it just disappears from his hand, ending up far away at the shrine just because some random dude walked inside.
