If he uses the assassinate action there is often a high probability that they will end up wounded instead and thus are able to return. You need a critical success to actually kill a hero (unless they are level 20 with the immortal trait as you mentioned).
The AI follows the same recovery time restrictions (for lords and heroes) that a player does. Note that there are several ways to lower the wound recovery time (at least for lords, a bit unsure on heroes).
As a example, if a lord defeats Vlad he gets a trait that gives him -4 recovery time, meaning that lord will always be able to return the next turn if you kill him. There are also several perks and items that can reduce wound recovery.
If you manage to critical success on a assassinate action the hero will be gone forever (unless its immortal). Off course they can still hire a new hero, but it will hopefully be lower level.
