Normally at start of the game you are allowed max of 1 of each hero, and you can hire that hero as soon as you have the building they require. if you look higher up the chain that enabled you to hire that hero (upgrades) you can see they say something like '+1 to recruitment capacity of X' that's what brings your limit up. You need to differentiate between when it says it allows you to hire (no impact on limit/cap) and when it says + capacity (increases limit/cap)
Lords can sometimes have traits that increase the limit as well, but for the most part if you want lots of heroes you just need to conquer a lot and build their buildings. But probably only on the large cities that can upgrade to level 5, you might note the first in the chain normally doesn't increase the capacity, just allows you to hire, so pointless to build them in level 3 towns. (some exceptions)
For your specific example : you want to go to the green chain and build elven gardens. This will allow you to hire your first noble. But notice it gives nothing to capacity, you could build 20 of these and you're still only allowed 1 noble only. When you upgrade to elven court, this upgrade says +1 to hero capacity for nobles. This will raise your cap.
But it's a level 4 building, so can't have these in small towns that cap at level 3.
